Intellectual Property Counsel - Nordson (Westlake, OH)

GENERAL SUMMARY:
Nordson is searching for an Intellectual Property Counsel to support the company’s long-term business strategy through the execution of strategy and ongoing management of a portion of the company’s intellectual property portfolio. This position will report directly to Nordson’s Chief Intellectual Property Counsel, and it will provide opportunities to partner with businesses across Nordson’s global footprint and work closely with key organizational leaders. You will provide legal support to Nordson’s engineering, marketing, sales, and procurement teams from product development through commercialization, and you will evaluate and guide potential innovations with a view toward comprehensive IP protection and enforcement, including through patents, trademarks, trade secrets, copyrights, and domain names.

ESSENTIAL DUTIES & RESPONSIBILITIES:
  • Work proactively with the businesses to encourage innovation
  • Understand the innovation and product development process as it relates to business and technical needs
  • Work with divisions and business groups and collaborate with the Nordson intellectual property team to execute global IP filing and enforcement strategy
  • Review and advise on invention disclosure submissions
  • Coordinate with outside counsel in the drafting, filing, and prosecution of U.S. and foreign patent applications, and worldwide enforcement of intellectual property rights
  • Evaluate patent validity and infringement issues, perform patentability assessments, product clearances, and freedom to operate, evaluate and assist with design-arounds, and draft opinions on same
  • Strategically monitor and provide advice regarding competitive IP filings
  • Work collaboratively with outside counsel to clear trademarks for use and registration, and in the filing and prosecution of trademark applications
  • Draft and negotiate a wide range of intellectual property related agreements, including non-disclosure, licensing, service, and development agreements
  • Provide IP litigation support
  • Work collaboratively with the other members of the Legal Department and businesses to conduct due diligence on the intellectual property assets of companies considered for acquisition and advise the businesses on intellectual property risks as appropriate
  • Track, manage, and control spending to stay within budgetary guidelines


MINIMUM QUALIFICATIONS:

Required Education:

  • Law degree from an accredited law school; membership in good standing in a state bar required

  • 7+ years of relevant experience; combination of law firm and in-house experience a plus

Your profile

BASIC QUALIFICATIONS

  • Bachelor’s Degree in chemistry, Chemical Engineering, Electrical Engineering, Mechanical Engineering, Chemical Engineering
  • Juris Doctorate Degree with license to practice law in the United States (Michigan, South Carolina, Ohio or Illinois preferred).
  • Minimum 3 years of patent application preparation and prosecution experience on U.S. and foreign patent filings (approx. 20 apps/year).
  • Minimum 7 years of professional working experience
  • In-depth understanding of and experience in both US and foreign patent practice and their intricate distinctions.
  • Experience primarily should include drafting and prosecuting domestic and international patent applications (85%).
  • Must be flexible and able to work independently and within a highly functional team under tight deadlines, handle multiple tasks, work collaboratively, think creatively, take initiative and respond quickly to changing priorities and goals.
  • Able to work in a collaborative teamwork style work environment and be willing to assist/support others.
  • Ability to think strategically and make decisions.
  • Fluency in English. German capability is a plus.
  • Willingness to travel domestically and internationally (up to 30%)
