Trademark Paralegal - Dinsmore & Shohl (Cleveland, OH)

Dinsmore is seeking a trademark paralegal at our Cleveland, OH location. The position will be responsible for providing trademark specific paralegal support to attorneys in the Intellectual Property Department.

Responsibilities

  • Perform high quality, billable work
  • Correspond with foreign associates regarding searching, filing, maintaining, and enforcing trademarks of our clients
  • Conduct preliminary clearance searches  through vendor database
  • Conduct research to gather and store information regarding the use of trademarks for enforcement and maintenance
  • Review and revise affidavits/declarations/oppositions to ensure accuracy and completeness of client information
  • Prepare, file, and monitor trademark applications
  • Draft responses to office actions
  • Draft oppositions to applications for conflicting trademarks
  • Draft affidavits of use and file with the USPTO
  • Draft renewal applications
  • Prepare and/or obtain documents for legalization
  • Review and organize files, reviewing docket for deadlines
  • Assist with copyright filings
  • Assist with preparing trademark-related agreements
  • Assist with enforcement matters to defend client trademarks and copyrights


Requirements

  • Must have a college degree, paralegal certificate, or relevant work experience
  • Two or more years of trademark experience preferred
  • Proficiency with the USPTO’s online tools, including Trademark Electronic Application System (TEAS) and online tools of the Assignment Branch and the Trademark Trial and Appeal Board (TTAB) preferred
  • Domestic and foreign filing experience preferred
  • General knowledge of intellectual property filing and prosecution rules/regulations is required
  • Experience with Anaqua docketing system preferred
  • High attention to detail and accuracy of work
  • Demonstrated ability to work professionally and confidentially with a variety of personalities from all levels of an organization
  • Proven organizational and multi-tasking skills

The Role:

MRI Software is seeking an in-house Legal Counsel to assist the global legal department. Experience in software and technology agreements is required. Experience in employment law matters and corporate governance and regulatory compliance is helpful. The individual will be expected to assist with various compliance and contract issues and such other duties as assigned by the General Counsel.  

Primary areas of focus will include: 

- Serve as a first-line review of sales contracts 
- Draft and negotiate complex commercial contracts including software licenses, supply, outsourcing, procurement, IT and services contracts 
- Client negotiations  
- Corporate organization and compliance  
- Dispute resolution  
- Third-party vendor agreements  
- Provision of legal guidance to senior management  
- Support to the Data Privacy team   
- Where appropriate, respond to Data Subject Access Requests and other privacy emails 
- Handle confidential matters on a regular basis requiring discretion and judgment 
- Compose, process and edit Word and Excel Documents and confidential correspondence as requested 
- Occasional legal research and writing assignments 
- Other duties as assigned by the General Counsel 

This position will afford the opportunity to be exposed to an acquisitive and fast-paced corporate culture from a legal perspective. The role will involve advising the business and liaising with a range of stakeholders internally and externally including clients, partners, and vendors globally. - A minimum of 2+ years legal experience
