Patents define an inventor’s exclusive rights via claims. The claims are drafted in varying degrees of technical specificity, such that each claim is legally distinct—some may be valid or infringed while others are not. Yet when it comes time to remedy infringement, the differences among the claims are too often treated as meaningless. Professor Brean’s presentation will explore the nature of patent remedies and demonstrate how meaningful differences in claim scope can result in meaningfully different remedies. Focusing on dependent patent claims, he will show, for example, how courts have routinely side-stepped the question of how a damages award might change if more or fewer claims are infringed. He will also show how parties (and their experts) can leverage the degree of infringement into better judgment outcomes.

In that role, he advised the President, the Secretary of Commerce and the Administration on intellectual property policy matters. He was instrumental in achieving the greatest legislative reform of the U.S. patent system in generations through passage and implementation of the Leahy‑Smith America Invents Act, signed into law by President Obama in September 2011.
