Topic: Post-Mortem IP: The Right of Publicity after Death
Keynote Speaker: Mike Serra, Corporate Counsel at Cisco (visiting from Detroit, MI)
The right of publicity is a state-law IP right that enables a party to sue for the appropriation of the commercial value of a person’s identity, but how does death impact this right? While a party’s right to privacy generally ends upon death, publicity rights may continue. With the rise of generative AI, new AI songs are bringing late artists, like John Lennon and Tupac, back from the dead, such that the consideration of publicity rights is more important than ever. Post-mortem IP rights can be complex as there is no federal cause of action and state laws vary on publicity rights and extending them post-mortem.
Mike is a senior corporate counsel focused in regulatory affairs, cyber security and national security at Cisco. He is a Certified Information Privacy Professional in Europe (CIPP/E) and Certified Information Privacy Technologist (CIPT). Mike previously served as product counsel for Cisco's cloud-based security offerings. Prior to joining Cisco, he worked at a large business law firm in Detroit where he was focused in IP rights and litigation. Mike is also a 2022 recipient of the prestigious Crain’s Detroit Business 40 under 40 award.
